Terms of Service

These Terms of Service ('Terms') govern your access to and use of the Comic4u platform operated by Comic4u ('we', 'us', 'our'). By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Provider

2. Eligibility and Account Registration
You must be at least 18 years of age to create an account and use our services. By registering, you confirm that you are of legal age and that the information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@comic4u.com if you suspect any unauthorised access to your account.
Account sharing is not permitted. Each account may only be used by one individual.
3. Services and Credits
Comic4u provides an AI-powered comic and story generation service. Access to generation features requires purchasing credits or an active subscription. Credits are a virtual currency redeemable exclusively for generating content on the platform.
- Credits are non-transferable and have no monetary value outside the platform.
- Credits cannot be exchanged for cash or other goods or services.
- Unused credits remain valid for the duration of your account unless stated otherwise.
- Prices are listed in Euro (EUR) inclusive of applicable VAT where required.
4. Payments and Billing
All payments are processed securely by Stripe, Inc. By providing payment information, you authorise us to charge the applicable fees. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
You may cancel your subscription at any time via your account settings. Access continues until the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable consumer protection law.
5. Right of Withdrawal (EU/EEA Consumers)
If you are a consumer resident in the EU or EEA, you have the right to withdraw from a purchase within 14 days without giving any reason ('cooling-off period'), pursuant to Directive 2011/83/EU and § 312g BGB.
However, by expressly requesting immediate commencement of the digital service (comic generation) during the withdrawal period, you acknowledge that your right of withdrawal is forfeited once the service has been fully performed. For subscription plans where service delivery has not yet begun, the standard 14-day withdrawal right applies.
To exercise your right of withdrawal, please send an unambiguous statement to hello@comic4u.com before the period expires. Refunds will be processed within 14 days using the same payment method as the original transaction.
6. Intellectual Property and Content Rights
The Comic4u platform — including its design, algorithms, models, and branding — is protected by copyright and other intellectual property laws. All rights not expressly granted are reserved.
6.1 Your Input Content
You retain ownership of the inputs (story descriptions, character details) you provide. By submitting inputs, you grant us a non-exclusive, worldwide licence to process them solely for the purpose of generating your requested content.
6.2 Generated Output
To the maximum extent permitted by applicable law, we assign all rights in the AI-generated output to you. You may use generated content for personal and commercial purposes, subject to these Terms and applicable third-party rights.
We make no warranties regarding the originality, uniqueness, or non-infringement of generated content. Similar outputs may be generated for different users. You are responsible for reviewing output before publication or commercial use.
6.3 Platform Licence to Use Content
You grant us a limited licence to store, process, and transmit your content and generated output solely as necessary to provide the service. We may also use anonymised, aggregated data to improve our models and platform.
7. Prohibited Uses
You must not use the platform to:
- Violate any applicable national or international law or regulation
- Generate content that exploits or harms minors in any way
- Create non-consensual intimate imagery or deepfakes of real persons
- Generate content that is hateful, defamatory, harassing, or incites violence
- Infringe the intellectual property, privacy, or personality rights of third parties
- Spread misinformation or deliberately misleading content
- Send spam or unsolicited communications
- Reverse-engineer, decompile, or circumvent platform security measures
- Use automated tools (bots, scrapers) to access the service without our written consent
- Introduce malware or conduct denial-of-service attacks
8. Disclaimer and Limitation of Liability
The platform is provided 'as is'. We do not guarantee uninterrupted, error-free, or secure operation. AI-generated content may be inaccurate, incomplete, or unsuitable for specific purposes. Always review output before making decisions based on it.
To the extent permitted by German law (§§ 521, 599, 680 BGB and §§ 305 et seq. BGB), our liability is limited as follows:
- We are fully liable for damages caused by wilful misconduct or gross negligence, as well as for death, personal injury, or harm to health.
- For simple negligence, we are only liable if a material contractual obligation (Kardinalpflicht) is breached, and then only for foreseeable, typical damages.
- We exclude liability for loss of profit, indirect damages, or consequential losses to the extent permitted by law.
- We are not liable for the content of third-party websites linked from our platform.
9. Availability and Service Changes
We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice where practicable. Active subscribers will be notified of significant changes by email.
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible.
10. Termination
We may suspend or terminate your account if you breach these Terms or if we are required to do so by law. We will provide reasonable notice before termination where possible, unless the breach is severe or immediate action is required for security reasons.
You may delete your account at any time via your account settings. Upon termination, your right to access the service ceases. We will handle your data in accordance with our Privacy Policy.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For disputes with consumers, the mandatory consumer protection provisions of the consumer's country of habitual residence shall apply.
The courts of Berlin, Germany shall have jurisdiction for any disputes arising from or relating to these Terms, to the extent permitted by applicable law.
12. Online Dispute Resolution
The European Commission provides an Online Dispute Resolution (ODR) platform for resolving disputes arising from online contracts: https://ec.europa.eu/consumers/odr/

13. Amendments
We may amend these Terms at any time. We will notify registered users of material changes by email at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
If you do not agree to the changes, you may terminate your account before the effective date.
14. Severability
If any provision of these Terms is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions shall continue in full force and effect.
